What Exactly Has The FTC Been Doing?
For years, the Federal Trade Commission has illegally used Section 13(b) of the FTC Act to rob companies of BILLIONS of dollars. Here's their modus operandi:
- Choose a company that seems like an easy target.
- File a complaint to a district court accusing the company of fraud or deceptive practices, hold an ex parte hearing, and convince the court to grant an temporary restraining order, appoint a receiver, and freeze ALL of the assets of the company and its owners. This means the FTC convinces the court to effectively shut down a business and freeze all of the assets of the company and its owners before the company and its owners even knows what's goin on (before they even get a chance to defend themselves).
- With the defendants (the company and its owners) left in a position with no income or access to their funds, the FTC typically wins by default and forces the company to pay them large sums of money under the guise of "returning funds to harmed consumers."
- The FTC then stuffs their pockets with about 95% of the money they collect for "consumer redress" and only pays about 5% to the so called "harmed consumers." Their own stats show this.
Will Opposing this bill prevent the FTC from retrieving money for consumers who have been scammed?
Absolutely NOT! The FTC has a legal remedy already in place (Section 19 of the FTC Act) that allows them to retrieve ill-gotten gains while affording all parties their Constitutional rights.
